Terms of Use

Acceptance

By creating an account and using LatiGen, you agree to these terms and to the Privacy Notice. If you do not agree, do not create an account.

1. Nature of the Services

The Services provide personal health organization, BP logging, BP forecasting, trend analysis, readiness planning, and optional Pilot AME Planner features, for informational and planning purposes only. They are not medical advice, diagnosis, treatment, prescribing, medication management, emergency care, FAA advice, AME advice, legal advice, employment advice, insurance advice, or a certification decision.

2. No clinician, FAA, or AME relationship

Your use of the Services does not create a doctor–patient, clinician–patient, AME–applicant, fiduciary, or agency relationship with the Company. The Company is not the FAA and does not represent the FAA. We do not certify pilots, issue or decide medical certificates, or communicate with the FAA or an AME unless you expressly direct us to through a feature that clearly enables that disclosure.

3. Your responsibilities

You are responsible for entering accurate, complete information; for confirming BP measurements, medication lists, medical history, and readiness summaries before relying on or sharing them; and for protecting your account credentials and reporting suspected unauthorized access. Do not start, stop, or change medication, treatment, exercise, flying, work, or safety-sensitive activity based only on the Services. Seek immediate medical care for urgent symptoms or emergencies.

4. Forecasting limitations

Forecasts, ranges, probabilities, readiness summaries, and checklists are estimates based on the information you provide and evidence available to the system. They can be wrong if your information is inaccurate, incomplete, outdated, or not representative of your current condition, and they do not guarantee any BP, medical, certification, examination, clinical, or regulatory outcome.

5. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE COMPANY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION, AND DOES NOT WARRANT THAT THE SERVICES WILL PRODUCE ANY PARTICULAR HEALTH, BP, AVIATION-MEDICAL, CERTIFICATION, OCCUPATIONAL, OR REGULATORY OUTCOME.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS OR DATA; LOSS OF CERTIFICATION, EMPLOYMENT, OR FLIGHT PRIVILEGES; BUSINESS INTERRUPTION; OR OTHER DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

7. Changes to Services and legal terms

We may update the Services, Privacy Notice, Terms of Use, and consent text from time to time. For material changes we will provide notice as required by law. Continued use after updated terms become effective means you accept them, subject to applicable law. If you do not agree, stop using the Services and contact us about account closure or data requests.

8. Account suspension and termination

We may suspend or terminate access if we believe an account has been used in violation of these terms, to protect the Services or other users, or to comply with law. On account closure, data is handled per the retention policy in the Privacy Notice (one year).

9. Governing law & contact

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Massachusetts for any dispute arising from or relating to the Services.
